Adriano Espaillat for Congress (“we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information you provide when you opt in to our SMS/MMS text messaging program (the “Program”). •       Mobile phone number: The mobile phone number you provide when opting in to the Program.

•       To send you recurring SMS/MMS messages related to voter outreach, campaign events, election reminders, and get-out-the-vote efforts.

•       To process and honor your opt-in and opt-out requests.

•       To respond to your inquiries and provide customer support when you text HELP.

•       To maintain records of consent for compliance with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA Messaging Principles and Best Practices.

•       To personalize the content and frequency of messages based on your location and expressed interests.

•       To improve our messaging program and campaign outreach efforts.

4. Information Sharing and Disclosure

We do not sell, rent, lease, or share your mobile phone number or personal information collected through this Program with unaffiliated third parties for their own marketing purposes. We may share your information only in the following limited circumstances:

•       Service Providers: We may share your information with trusted third-party service providers who assist us in operating the messaging program (such as our SMS platform provider, Twilio). These providers are contractually obligated to use your information only to perform services on our behalf and to protect your information.

•       Legal Requirements: We may disclose your information if required to do so by law, regulation, legal process, or governmental request.

•       Campaign Operations: We may share your information with authorized campaign staff, volunteers, and consultants for the purpose of conducting campaign-related outreach on behalf of Adriano Espaillat for Congress. All such individuals are required to handle your information in accordance with this Privacy Policy.

•       FEC Compliance: We may disclose donor and contributor information as required by the Federal Election Commission (FEC) and applicable campaign finance laws. This does not include your mobile phone number.

5. Data Retention

We retain your mobile phone number and opt-in records for as long as you remain subscribed to the Program and for a reasonable period thereafter to comply with our legal obligations, resolve disputes, and enforce our agreements. If you opt out of the Program, we will retain a record of your opt-out request to ensure we do not send you further messages. Consent records are retained in accordance with applicable legal requirements, including FEC recordkeeping obligations.

6. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect through the Program from unauthorized access, use, alteration, and disclosure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security of your information.

7. Your Rights and Choices

You have the following rights regarding your personal information:

•       Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message. You may also text STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT.

•       Access and Correction: You may request access to the personal information we hold about you, or request that we correct any inaccuracies, by contacting us at info@adrianoespaillat.com.

•       Deletion: You may request that we delete the personal information we have collected about you, subject to certain exceptions required by law (such as FEC recordkeeping requirements).

•       Do Not Sell: We do not sell your personal information. If you are a California resident, you have the right to know that we do not sell personal information as defined under the California Consumer Privacy Act (CCPA).

8. Children’s Privacy

This Program is not intended for individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will promptly delete that information.
